1. This review is commissioned in accordance with the powers of the Comptroller & Auditor General as set out in the Public Finance Jersey Law 2005 to take place in the light of:
(1) the importance accorded to the States’ activities to regulate environmental pollution;
(2) the public concern that these activities may not be achieving their objectives; and
(3) the public concern that these regulatory activities may not be effective to prevent unacceptable breaches of acceptable environmental protection standards.
2. The purpose of the review is to examine:
(1) the arrangements for environmental regulation and protection;
(2) the adequacy of legislation governing environmental regulation and protection;
(3) the appropriateness of the processes in place to implement the provisions of the governing legislation;
(4) the appropriateness of the testing regime including the results of independent testing of the Department’s testing regime; and
(5) the appropriateness of the Department’s action on the basis of the results of its testing regime and its other activities.
3. The review will be conducted by and under the supervision of the Comptroller & Auditor General with the benefit of such independent expert advice and testing assistance as may appear to him to be necessary. The reasonable costs of such advice and testing assistance will be met by the Planning & Environment Department.
4. The outcome of the review will be a report prepared and published in accordance with the provisions of the Public Finance Jersey Law 2005 and the C&AG’s normal practice.
